The depth and breadth of the firm’s litigation practice is a clear reflection of our varied client base. For our business clients, we offer representation in litigation matters ranging from complex contract disputes to business tort defense. The firm also represents individuals in matters such as business dissolution actions, contract disputes, discrimination claims, and real estate litigation. Depending on the nature of the claim and the parties involved, the firm may undertake representation on either the plaintiff or the defense side. The experience garnered from this approach gives our attorneys a critical understanding of both sides of the litigation arena, an understanding which allows for effective representation regardless of a client’s particular litigation posture.
At the outset of all cases, we work with clients to identify goals, develop a plan, evaluate the likelihood of success, and assess the anticipated costs of pursuing a particular strategy. It is our belief that spending this extra time at the beginning of a matter ultimately saves our clients valuable time and money.
The following are examples of some of the areas covered by our litigation practice:
- Contract Disputes:
We represent businesses and individuals in disputes arising from contracts for both goods and services, commercial disputes, breaches of real estate agreements and home improvement contracts. - Business Litigation:
We represent clients in dissolutions of business relationships and in cases involving fraud or other corporate malfeasance. - Employment Litigation:
We litigate all types of employment-related actions, from employment contract claims to suits for wrongful discharge and employment discrimination. We also counsel clients on being proactive so as to mitigate future litigation risks, offering legal advice on how to structure severance arrangements and how to develop effective internal policies. - Foreclosure, Consumer Finance, and Creditors’ Rights:
We represent lenders in workouts and litigation cases. We pursue actions on notes, mortgages, guarantees, and other instruments, enforce foreign and domestic judgments, challenge fraudulent transfers and foreclose mortgages. We also defend institutional finance companies, creditors, and debt collection entities who are named defendants in adversary proceedings under federal laws such as the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), and the Fair Debt Collection Practices Act (FDCPA) as well as various state and common law claims such as alleged violations of predatory lending laws, the Connecticut Unfair Trade Practices Act (CUTPA) and the Connecticut Unfair Insurance Practices Act (CUIPA). - Appellate Practice:
Our firm represents both appellants and appellees in state and federal appellate courts.
In addition to the above, our litigation practice also includes representation of clients in arbitration and mediation programs as alternative means of dispute resolution.
